1. What Nearby Flyer is

Nearby Flyer ("we", "us") operates a public, informational directory of aviation services — flight instructors, flight schools, aircraft rentals, flying clubs, and maintenance shops — located at airports across the United States. We are not an aviation business, broker, agent, escrow service, or party to any agreement formed between you and any listed provider.

2. Eligibility & account

You must be at least 18 years old to create an account. You agree to provide accurate information, keep your credentials secure, and are responsible for all activity on your account.

3. Listings

Anyone with an account may submit a listing. By submitting, you represent that the information is accurate, that you are authorized to represent the listed business or yourself as the certificated airman, and that you will keep the listing current. We may edit, suspend, or remove any listing at our discretion.

4. Acceptable use

You agree not to:

• Post false, misleading, or fraudulent information, including impersonating another person or business.
• Misrepresent ratings, endorsements, certifications, currency, insurance, or aircraft airworthiness status.
• Scrape, harvest, or redistribute listing contact information for unsolicited marketing.
• Use the site to harass other users or interfere with the operation of the service.

5. No verification, no endorsement

We do not independently verify pilot certificates, instructor ratings, medicals, aircraft airworthiness, insurance, business licenses, or any other claim made in a listing unless a listing is explicitly marked "Verified." Even verified listings can become out of date. You are solely responsible for confirming a provider's qualifications, currency, and insurance directly with that provider and, where applicable, with the FAA before flying.

6. Aviation safety disclaimer

Aviation involves inherent risk. Nothing on Nearby Flyer constitutes flight training, dispatch authority, an airworthiness determination, or a legal opinion. See our Liability Disclaimer.

7. Payment

Featured-listing placements and other paid services are billed separately and governed by their own checkout terms. Refunds are at our discretion.

8. Termination

We may suspend or terminate accounts and remove listings at any time, with or without notice, for any violation of these Terms or for any other reason we deem necessary to protect the service or its users.

9. Limitation of liability

To the maximum extent permitted by law, Nearby Flyer and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the site or any interaction with a listed provider. Our total aggregate liability for any claim relating to the service shall not exceed one hundred US dollars ($100).

10. Governing law

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws principles.

11. Changes

We may update these Terms at any time. Continued use of the site after a change constitutes acceptance of the updated Terms.
